Terms of Service

These terms cover your use of the WorkGraph AI website, the free diagnostic, and the WorkGraph AI platform (together, the “Services”), provided by WorkGraph AI LLC (“WorkGraph AI”, “we”). If you are a client, your signed agreement with us governs the engagement and the platform, and wins wherever it differs from these terms.

1. Using the Services

By using the Services you agree to these terms. If you use them for a company, you confirm you can agree for it, and “you” means the company. The Services are for business use.

2. What the Services are

The website describes our work. The free diagnostic gives an organization a read on where it stands, based on your answers. The platform maps a client's work and supports the Blueprint engagement. We may change, add or remove features.

The diagnostic and other AI-assisted outputs are information to help you decide, not professional, legal, employment or financial advice. A person on our team reviews every recommendation in an engagement before you see it, but the decisions you make with them are yours.

3. What you give us

Give us accurate details, and only share other people's personal data when you are allowed to. If you have platform credentials, keep them to yourself; you are responsible for what is done with them.

4. What you may not do

• Break the law with the Services, or use them to harm anyone.
• Get into parts of the Services or our systems you are not given access to, or test, probe or get around their security.
• Disrupt the Services, upload malware, or scrape them.
• Copy, reverse engineer, or use the Services to build a competing product, except where the law allows it.

We may suspend access to anyone who does.

5. Our property

The Services and their content belong to WorkGraph AI or our licensors. You may use them for your own business purposes under these terms. WorkGraph AI is a trademark of WorkGraph AI; you need our written consent to use it, or our logos.

6. Your data

What you submit stays yours. You let us use it only to provide the Services to you and as our Privacy Policy says. We keep it confidential, and share it only with the providers that run the Services for us, under confidentiality terms, or when the law requires it. We delete your data on request.

7. No warranty

The Services are provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement. We don't promise the Services will be uninterrupted or error-free, or that any output is complete or accurate.

8. Limit of liability

To the extent the law allows, neither WorkGraph AI nor its people or suppliers are liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for anything arising from these terms or the Services is limited to the greater of what you paid us for the Services in the 12 months before the claim, or US $100.

Nothing here limits liability that the law does not allow us to limit.

9. Indemnity

You will cover our reasonable costs, including legal fees, from claims that arise from your breach of these terms, your breach of the law or of someone else's rights, or data you submit without the right to.

10. Ending

You can stop using the Services at any time. We may end or suspend access if you break these terms, if the law requires it, or if we stop offering the Services. Sections 5 to 9 and 11 still apply afterwards.

11. Law and disputes

Georgia law governs these terms, without its conflict of laws rules. The state and federal courts in Georgia hear any dispute about them, unless a law that protects you says otherwise.

12. Changes and the rest

When we change these terms, we update the date at the top of this page; if the change is material, we say so on the site. These terms, the Privacy Policy and the Cookie Policy are the whole agreement for your use of the Services, unless you have a signed agreement with us. If part of these terms can't be enforced, the rest still applies. Not enforcing a term is not a waiver. You may not transfer these terms without our consent; we may transfer them in a merger or sale.
